1. Agreement to Terms
These Terms of Use ("Terms") govern your use of Studio 3000 LLC ("Studio 3000," "we," "us," "our") consumer iOS applications, including Mirror and any future Studio 3000 iOS apps that reference these Terms (collectively, the "Apps"). By downloading, accessing, or using an App, you agree to these Terms.
2. Eligibility
You must be at least 13 years old to use our Apps. If you are under the age of majority where you live, you may use the Apps only with permission from a parent or legal guardian.
3. License to Use the Apps
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps on Apple-branded devices that you own or control, solely for personal, non-commercial use and as permitted by Apple's App Store terms.
4. App Store and Apple-Specific Terms
- These Terms are between you and Studio 3000, not Apple.
- Apple is not responsible for the Apps or their content, maintenance, or support.
- Apple has no obligation to provide maintenance or support services for the Apps.
- In the event of any failure of the Apps to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the App, if any, as permitted by Apple's policies.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
- Your use of the Apps is also subject to Apple's Licensed Application End User License Agreement. In the event of a conflict between these Terms and Apple's standard EULA, these Terms control to the extent permitted.
5. Subscriptions, In-App Purchases, and Billing
Some App features may require a paid subscription or in-app purchase.
- All purchases are processed by Apple through your App Store account.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- You can manage or cancel subscriptions in your Apple ID account settings.
- We do not control Apple billing, payment methods, or refunds. Refunds are handled by Apple under Apple's applicable policies.
- Prices and available features may change where permitted by law.
6. Acceptable Use
You agree not to:
- Use the Apps in a way that violates any law or regulation.
- Reverse engineer, decompile, or attempt to extract source code except where prohibited by law from restricting such rights.
- Interfere with App operation, security, or integrity.
- Use the Apps to harass, abuse, or harm others.
- Use the Apps in safety-critical contexts where failure could cause injury, death, or severe property or environmental damage.
7. User Content and Device Media
If an App lets you capture, create, or share images or other content, you are responsible for your use of that content and for obtaining any required rights or permissions. You retain ownership of content you create, but you grant us a limited license to process that content only as needed to provide App functionality.
8. Privacy
Your use of the Apps is also governed by our Privacy Policy, available at studio-3000.com/privacy-policy.html. Please review it carefully to understand how data is handled.
9. Third-Party Services
The Apps may integrate with or rely on third-party services for analytics, crash reporting, subscription management, or other functionality. These services are governed by their own terms and privacy policies. Studio 3000 is not responsible for the availability, accuracy, or practices of any third-party service. Your use of such services is at your own risk.
10. Intellectual Property
The Apps, including their software, design, visual elements, trademarks, and related materials, are owned by Studio 3000 or its licensors and are protected by applicable intellectual property laws. Except for the limited license in Section 3, no rights are granted to you.
11. Service Changes and Availability
We may modify, suspend, or discontinue any App feature at any time. We are not liable for any modification, suspension, or discontinuation, to the fullest extent permitted by law.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the Apps are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Apps will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the fullest extent permitted by law, Studio 3000 and its officers, members, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities arising out of or related to your use of the Apps. Our aggregate liability for all claims relating to an App will not exceed the amount you paid for that App or related subscription in the 12 months before the claim arose.
14. Indemnification
You agree to defend, indemnify, and hold harmless Studio 3000 and its affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of an App, your violation of these Terms, or your violation of law or third-party rights.
15. Dispute Resolution
You and Studio 3000 agree to resolve any disputes arising out of or relating to these Terms or the Apps through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if eligible.
Class action waiver: All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Jury trial waiver: If for any reason a claim proceeds in court rather than arbitration, both parties waive any right to a jury trial.
16. Export Compliance
You may not use or export the Apps except as authorized by United States law and the laws of the jurisdiction in which the Apps were obtained. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
17. Termination
These Terms remain in effect until terminated. We may suspend or terminate your access if you materially violate these Terms. You may stop using the Apps at any time by uninstalling them. Sections that by their nature should survive termination will survive.
18. Electronic Communications
By using the Apps, you consent to receive communications from us electronically, including through App Store notifications, in-app notices, or email if you have contacted us. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
19. Governing Law
These Terms are governed by applicable laws of the United States and the state where Studio 3000 is organized, without regard to conflict-of-laws principles, except where mandatory local law requires otherwise.
20. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy and any app-specific terms below, constitute the entire agreement between you and Studio 3000 regarding the Apps and supersede all prior agreements.
21. Changes to These Terms
We may update these Terms from time to time. If we do, we will update the "Last Updated" date above. Your continued use of an App after updated Terms become effective means you accept the revised Terms.
22. App-Specific Terms (Current: Mirror)
This section adds app-specific terms for Mirror and can be replaced or expanded for future Studio 3000 apps with minimal edits.
If any app-specific term conflicts with these general Terms, the app-specific term controls for that app.
- Core functionality: Mirror uses your device camera to display a live, on-device mirrored view.
- Camera permissions: Mirror requires camera access to function. If camera permission is denied, key functionality may be unavailable.
- No cloud processing by default: Mirror's core image processing occurs locally on your device.
- Safe use: Do not use Mirror while driving, cycling, operating machinery, or in other situations requiring full attention.
